1. Introduction

Welcome to fairvalue.pk ("Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the fairvalue.pk website, services, and any related applications. By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

fairvalue.pk is a classifieds marketplace that enables users to post advertisements for goods and services and to browse listings posted by others. We facilitate connections between buyers and sellers but do not participate in the actual transactions between users.

2. Eligibility

You must be at least 18 years of age to use fairvalue.pk. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

3. No Account Required

fairvalue.pk is designed to operate without mandatory user registration. You may post advertisements and browse listings without creating an account. When you post an ad, you will receive a unique secret management link that serves as your sole means of editing or deleting your listing. You are solely responsible for safeguarding this link. fairvalue.pk cannot recover lost management links.

4. Posting Advertisements

When posting an advertisement on fairvalue.pk, you agree to the following:

• All information provided in your ad must be accurate, truthful, and not misleading.
• You must have the legal right to sell the item or offer the service described in your ad.
• You must not post items that are prohibited under Pakistani law or our Prohibited Items Policy.
• You must provide a valid WhatsApp number for buyer communication.
• You must not post duplicate ads for the same item or service.
• Images uploaded must be of the actual item being sold and must not infringe on any third-party intellectual property rights.
• You must not use the Platform for any illegal, fraudulent, or deceptive purposes.

5. Transactions Between Users

fairvalue.pk is a platform that connects buyers and sellers. We do not participate in, mediate, or guarantee any transaction between users. All transactions are conducted directly between the buyer and seller, typically via WhatsApp communication and cash on delivery payment. fairvalue.pk:

• Does not guarantee the quality, safety, legality, or availability of items listed.
• Does not guarantee the accuracy of listings or the identity of users.
• Is not responsible for any disputes, damages, or losses arising from transactions between users.
• Does not process payments or handle delivery of goods.

6. Content Moderation

fairvalue.pk employs AI-powered content moderation to review advertisements before they are published. We reserve the right to reject, remove, or modify any listing that violates these Terms, our Community Guidelines, or our Prohibited Items Policy. We may also suspend or restrict access to users who repeatedly violate our policies.

7. Intellectual Property

All content, design, logos, and trademarks on fairvalue.pk are the property of fairvalue.pk or its licensors. You may not copy, reproduce, distribute, or create derivative works from any content on the Platform without our prior written consent. By posting content on fairvalue.pk, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the operation of the Platform.

8. Limitation of Liability

To the maximum extent permitted by law, fairvalue.pk and its founders, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms shall not exceed PKR 10,000.

9. Indemnification

You agree to indemnify and hold harmless fairvalue.pk, its founders, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Karachi, Pakistan.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of fairvalue.pk after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
